Terms of Service

1. About BrickMind

BrickMind is a software platform that helps Australian landlords manage residential and commercial rental properties. It provides tools for rent collection, maintenance coordination, compliance tracking, financial reporting, and tenant communication.

BrickMind is a technology platform, not a licensed real estate agent or property manager. Landlords remain legally responsible for their properties and must comply with applicable tenancy laws in their state or territory.

2. Beta Access

During the private beta period, access to BrickMind is by invitation only. Beta access is provided free of charge. Features may change, be removed, or be unavailable without notice. We cannot guarantee uptime or data integrity during beta.

3. Your Responsibilities

  • You must be a legal owner or authorised manager of any property you add to BrickMind
  • You must comply with the Residential Tenancies Act (or equivalent) in your state or territory
  • You must obtain consent before adding tenant contact details to the platform
  • You are responsible for reviewing and approving any AI-generated actions (notices, communications, maintenance approvals)
  • You must not use the platform for any unlawful purpose

4. Payments

Rent collection is processed via PayTo (NPP) through Monoova, a licensed Australian payment provider. By using the payment features, you agree to Monoova's terms and conditions.

BrickMind does not hold funds in trust. Rent is collected directly into the landlord's nominated bank account. BrickMind is not responsible for payment failures, bank errors, or disputes between landlords and tenants.

5. AI Features

BrickMind uses AI (Claude by Anthropic) to assist with property management tasks. AI-generated content — including notices, reports, recommendations, and communications — should be reviewed before use. BrickMind is not responsible for errors in AI-generated content.

Tax-related features (ATO categories, deduction summaries) are for reference only and do not constitute tax advice. Consult a registered tax agent for advice specific to your situation.

6. Limitation of Liability

To the maximum extent permitted by law, BrickMind's liability for any claim arising from your use of the platform is limited to the amount you have paid for the service in the 12 months preceding the claim.

BrickMind is not liable for: missed compliance deadlines, failed payments, tenant disputes, property damage, or losses arising from reliance on AI-generated content.

7. Termination

Either party may terminate access to the platform at any time. On termination, you may request an export of your data. BrickMind will retain records as required by the ATO (5 years).

8. Governing Law

These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.
